2. What data we collect

We collect only the data needed to provide and improve the MarKomX managed AI marketing service:

  • Account data: name, email address, company name, phone number, and billing address.
  • Content inputs: briefs, brand assets, documents, guidelines, and other materials you upload to help us produce your marketing content.
  • AI processing data: prompts, outputs, review notes, and revision history generated within your dedicated workspace.
  • Analytics and usage data: website visits, page views, feature usage, and performance metrics collected via cookies and analytics tools.
  • Payment data: billing information and transaction records are handled by Stripe; we do not store full payment card details.
  • Communication data: emails, support tickets, meeting notes, and feedback you share with us.

3. How we use your data

We use your data to:

  • Deliver the MarKomX service and produce your marketing deliverables.
  • Coordinate work between the 30+ specialist agents and your human Marketing Director.
  • Communicate with you about your account, campaigns, and support requests.
  • Process payments and manage subscriptions.
  • Improve our AI workflows, product quality, and customer experience.
  • Comply with legal, accounting, and regulatory obligations.

4. Legal basis for processing

We process personal data on the following legal bases:

  • Contract: processing necessary to provide the MarKomX service you subscribed to.
  • Consent: where you explicitly agree, for example to marketing communications or optional cookies.
  • Legitimate interest: for security, fraud prevention, service improvement, and direct communication about your account.
  • Legal obligation: to meet Swiss commercial and tax law requirements, and to respond to lawful requests.

5. Where data is stored and processed

MarKomX is hosted on EU-based servers. Your data is processed and stored within the European Economic Area, in environments that provide an adequate level of protection under EU data protection law.

We maintain per-customer isolation, role-based access, and a full audit trail. Your data is never used to train shared or public AI models.

6. How long we keep your data

  • Inquiry and prospect data: up to 24 months after the last contact, unless you request deletion earlier.
  • Client account and project data: up to 10 years after the end of the contractual relationship, as required by Swiss commercial law.
  • Analytics data: up to 26 months, then anonymised or deleted.
  • Payment records: retained for the period required by Swiss tax and accounting law.

7. Your data subject rights

Under the Swiss Federal Data Protection Act (nLPD/FADP) and the EU GDPR, you have the right to:

  • Access the personal data we hold about you.
  • Request correction of inaccurate or incomplete data.
  • Request deletion of your data, subject to legal retention obligations.
  • Restrict or object to certain processing.
  • Receive your data in a portable format.
  • Withdraw consent at any time.

8. Cookies and tracking

We use essential cookies to make the website work, and optional analytics cookies to understand how visitors use the site. You can manage your cookie preferences through the banner shown on your first visit.

Analytics data is collected in a privacy-friendly way and is not used for advertising profiling.

9. Third-party processors

We use carefully selected subprocessors to operate MarKomX. They process data only on our instructions and under appropriate data protection agreements:

  • Stripe — payment processing
  • Hosting and cloud infrastructure providers — Swiss and EEA-based
  • Email and support providers — communication delivery
  • Analytics providers — website usage insights

10. Data security

We apply technical and organisational measures including encryption in transit and at rest, access controls, regular backups, and review of our subprocessors.

11. AI-generated content and disclosure

MarKomX uses AI to draft and refine marketing content. As described in chapter 10, the only human reviewing the content before it reaches you is you, the Customer. We provide disclosure frameworks to help you comply with the EU AI Act and similar transparency requirements.

12. Changes to this policy

We may update this Privacy Policy as MarKomX evolves. The latest version is always available at https://markomx.com/en/legal/privacy/. Significant changes will be communicated by email or through the service.
